Equine New Owner Sale/Care Agreement THIS AGREEMENT entered into on this ______of _____20_________, between (hereinafter known as “Owner”) and Dove Hill Horse Ranch, Inc.(hereinafter known as “DHHR”) through this agreement is a legally binding agreement delineating the terms and conditions of the sell of the horse currently known to all parties as (hereinafter known as “said equine”)

Upon receipt of Owner’s signed agreement and covenant to provide all necessary care for said horse, DHHR, hereby transfers ownership of said horse to Owner for the remainder of said horse’s life or until such time as Owner cannot or will not continue such care for said horse. In either of the aforementioned instances, sole ownership and custody of said horse will automatically revert to DHHR. It is clearly understood and agreed that Owner has NO RIGHT TO SELL, TRANSFER OR CONVEY possession and/or ownership of said horse to any other individual or entity at any time for any reason. Owner shall provide all food, water (access to fresh water at all times), shelter, pasture area (with a minimum of one half acre with stall per horse), certified ferrier and licensed horse veterinarian care as is necessary to maintain said horse in good health and safety and shall provide a quality environment free of abuse, neglect, poor handling and/or mismanagement of the remainder of said horse’s lifetime. Owner shall keep DHHR informed of all changes to name (both horse and Owner), address, phone and status of said horse necessary to insure the protection of said horse and to enforce the provisions hereof

 

 Owner shall provide semi-annual dental checkups by a licensed veterinarian inoculations and all other routine veterinary care.

 Owner agrees to keep said horse up to date on all annual and semi-annual inoculations and all other routine veterinary care.

------DHHR suggests and recommends the following routine veterinary schedule: SPRING(April- May) inoculations to include Flu, Rhino, EWT, Western Nyle Encephalitis, Tetanus, Rabies and any other inoculations such as Potomac Horse Fever, Botulism, and Strangles that your veterinarian recommends for endemic diseases: FALL(October­ November)inoculations to include Flu, Rhino and any other inoculations your veterinarian recommends for endemic diseases.

 Paste worming must be given every 6-8 weeks (unless given daily in feed). DHHR strongly recommends rotating with Strongid and Ivermectrin. We strongly urge against the use of Quest Paste on minis and babies.

 Owner shall notify DHHR of said horse’s death with a certified death certificate.

 

 

DHHR retains the right to inspect any facility where said horse is kept at its discretion and without notice. If DHHR determines that abuse or

neglect exist, they retain the unilateral right to repossess said horse immediately or at such time as may be required by the circumstances. Should DHHR fail to immediately repossess said horse upon findings of abuse and/or neglect, such failure does not constitute a waiver of its right to do so subsequently.

In the event the said equine is returned to DHHR voluntarily by Owner, a thirty day written notice must be given to allow DHHR time to properly arrange to set up for said horse’s arrival. The owner agrees to continue to care for said horse and pay any necessary costs to continue to maintaining said horse in good health. At the time of return the owner must prove that said horse has a current negative Coggins test ( no less than 6 months old) and be up-to-date on inoculations, worming, dental and hoof care. Should said horse not be current on the above requirements, owner agrees to reimburse DHHR for necessary costs to bring said horse back-up-to date on the above requirements. If Owner does not pay for cost then said horse will not be returned until all expenses are paid in full.

Owner understands that said horse MAY have health limitations due to previous instances of abuse or neglect. DHHR hereby provides owner with the health records of said horse which were known to DHHR at and/or after the time DHHR obtained possession of said horse, and the special required medications and nutritional needs of said horse. This also applies to said horse born at DHHR breeding facilities either from DHHR breeding or a rescued mare. DHHR and Owner agree that DHHR makes the following disclosures as a courtesy to Owner and these disclosures are to the best of DHHR’s knowledge.

 

 

Nothing herein shall be construed as a claim, representation or warranty as to the temperament, health or mental disposition of said horse.

Owner understands that there may be limitations as to the type of riding appropriate for said horse. Owner agrees to ride said horse only in accordance with those limitations in order to ensure that there will be no additional injuries to said horse or Owner.

 

Owner also agrees that any injuries incurred through use of said horse by him/herself, family members, friends, etc. are solely his/her responsibility.

Transportation arrangements and costs are the responsibility of Owner at the time of transfer of ownership and as well as in the event that said horse is returned to DHHR.

This agreement shall be governed by the laws of the State of Florida and the parties hereto agree and personally submit to the

jurisdiction of the courts of the State of Florida should any dispute arise hereunder. The parties understand and agree that in the event action is required on the part of DHHR to recover said horse or to take any action to enforce this agreement, owner

 

 

shall be responsible for any and all costs incurred by DHHR including, but not limited to, legal fees, costs of suit, veterinary

services, rehabilitation, transportation, office and administrative

cost and such other costs as may be reasonable required

 

 

The foregoing is understood and agreed to by all parties as

indicated by the signatures below.
